§ 1. Service Provider and definitions

1. The Service Provider and party to the contract is FHU Kamil Orlicki, Tax Identification Number (NIP) 9860170083, REGON 321429588, registered address: Zwycięstwa 17a, 72-514 Kołczewo, Poland, e-mail: rezerwacje@orlidomek.pl, tel. +48 666 019 999, WhatsApp: +48 600 683 636, hereinafter referred to as the "Service Provider".

2. These Regulations set out the rules for booking and providing short-term accommodation services at "Orli Domek – wypocznij nad morzem", located at Wolności 5e, 72-514 Kołczewo, Poland, hereinafter referred to as the "Property".

3. "Lead Guest" means an adult who makes the booking and is a party to the contract. "Guest" means the Lead Guest and every person included in the booking.

4. "Price" means the total price of the service stated in the booking summary, including mandatory taxes and charges. Paid additional services selected by the Guest are shown separately.

5. "Durable medium" means, in particular, an e-mail or a PDF file attached to it that allows the content to be stored unchanged.

§ 2. Scope of the service

1. The service consists of making the Property available temporarily for a holiday stay on the dates and for the number of persons stated in the booking confirmation. It is not intended to meet permanent housing needs or establish a place of permanent residence.

2. The maximum number of overnight guests at the Property is 7, with the seventh place intended exclusively for a child under 4 years of age using a travel cot. A child, regardless of age, counts towards the occupancy limit.

3. The Price does not include a 24-hour reception service, daily cleaning, transport, meals or other services unless they are expressly stated in the offer or booking confirmation.

4. The photographs and equipment description define the standard of the Property. Minor changes to the equipment are permitted provided that they do not reduce the agreed standard or functionality.

§ 3. Booking and conclusion of the contract

1. A booking may be made through www.orlidomek.pl, the Smoobu booking form, by e-mail or telephone, or through an external booking platform.

2. Before submitting an online booking, the Guest receives at least the following information: dates and number of nights, number of persons, selected rate, paid extras, Price, payment schedule, cancellation terms, Service Provider details and information about the absence of the statutory right of withdrawal referred to in § 6.

3. An online booking is submitted by using the button labelled "Book and pay" or another equally unambiguous button indicating an obligation to pay, after actively confirming that the Guest has read these Regulations.

4. An online booking contract is concluded when the Guest receives an e-mail confirming that the Service Provider has accepted the booking. An automated message merely confirming receipt of an enquiry, if described as such, does not constitute acceptance of the booking.

5. For a booking arranged by telephone, the Service Provider sends the agreed terms and these Regulations on a durable medium. A contract with a consumer is concluded after the consumer submits a declaration accepting those terms, recorded on a durable medium.

6. The booking confirmation contains the parties' details, dates, number of persons, selected rate, Price, payments made, outstanding balance and payment deadline, as well as the version of the Regulations applicable to the booking.

7. The Lead Guest provides accurate information and promptly reports any changes. A booking may be made only by an adult who has legal capacity to enter into the contract.

8. If a booking is made through an external platform, the specific payment and cancellation terms shown on that platform apply to the extent that they were individually selected and confirmed at the time of booking. The stay rules contained in these Regulations apply accordingly.

§ 4. Price, payments and discounts

1. Before the contract is concluded, the Price is stated in Polish zlotys and includes all mandatory components known at the time of booking. A fee for additional services is charged only after the Guest expressly selects them.

2. If a booking is made at least 14 days before arrival, the Guest pays an advance payment equal to 50% of the Price at the time of booking, but not less than PLN 500 and not more than the full Price. The remaining Price is payable no later than on the arrival date, using the payment method stated in the booking confirmation.

3. If a booking is made less than 14 days before arrival, the full Price is payable at the time of booking.

4. The advance payment forms part of the Price. It is not a deposit (zadatek) within the meaning of Article 394 of the Polish Civil Code.

5. Payments may be made using the methods indicated in the booking form or confirmation, in particular by bank transfer, card, instant online transfer or cash, if the relevant method is offered. Payment is deemed made when the Service Provider's account is credited or the payment operator confirms the transaction.

6. The booking number and the Lead Guest's surname must be provided in the reference field of a standard bank transfer. The account number and recipient details are provided in the booking confirmation.

7. If a required payment is not made on time, the Service Provider may set an additional deadline of no less than 24 hours and inform the Guest that, if payment is still not made, the Service Provider may withdraw from the contract and release the dates. For bookings made shortly before arrival or where time is of the essence, the additional deadline may be shorter if later performance would no longer serve its purpose.

8. A discount code is applied in accordance with the terms stated when it is made available. The 10% non-refundable rate discount may be combined with a discount code. The discount code is applied first, followed by the non-refundable rate discount. Each discount and the final Price are displayed before the booking is submitted. If the terms of a particular code provide for a maximum combined discount, that limit must be disclosed to the Guest before the code is used.

9. If the Price is presented as reduced, the Service Provider also provides information about the lowest price required under the law currently in force.

§ 5. Rates, cancellation and change of dates

1. Before booking, the Guest selects the standard rate or, if available, the non-refundable rate. The selected rate is stated in the booking summary and confirmation.

2. Under the standard rate, the Guest may cancel the booking by sending a message to rezerwacje@orlidomek.pl. Cancellation takes effect when the Service Provider receives the message.

3. If a standard-rate booking is cancelled: a) at least 21 days before arrival – the cancellation fee equals the Price of the first night at the booked rate; b) from 14 to 20 days before arrival – the fee equals 50% of the Price; c) less than 14 days before arrival – the fee equals 100% of the Price.

4. If the amount paid exceeds the cancellation fee due, the difference is refunded using the same payment method within 7 days. If the amount paid is lower, the Guest pays the difference within 7 days of receiving the settlement, provided that this obligation complies with the law and the terms of the specific booking.

5. Under the non-refundable rate, the Price is reduced by 10% compared with the comparable standard rate and is payable in full at the time of booking. If the Guest cancels, arrives late, departs early or fails to arrive, the Price is not contractually refundable, except where a refund is required by mandatory law or because the service was not provided for reasons attributable to the Service Provider.

6. The Guest may request a change of dates no later than 14 days before arrival. A change is subject to availability and requires confirmation by both parties on a durable medium. The Price for the new dates is provided before the change is accepted. The original booking remains valid until the change is confirmed.

7. Early departure, late arrival or failure to use part of the stay for reasons attributable to the Guest does not reduce the Price unless the Service Provider expressly agrees to a different settlement.

8. If the Service Provider cancels the booking for reasons for which it is responsible, it refunds all payments received within 7 days. This does not exclude any further rights available to the Guest under the law.

9. If performance becomes impossible due to circumstances for which neither party is responsible, the parties settle payments in accordance with mandatory law, in particular in respect of the part of the service that cannot be provided.

§ 6. No statutory right of withdrawal

1. Pursuant to Article 38(12) of the Polish Consumer Rights Act of 30 May 2014, a consumer has no statutory 14-day right to withdraw from a distance contract concerning accommodation services other than for residential purposes if the contract specifies the date or period of performance.

2. The absence of the statutory right of withdrawal does not exclude the contractual cancellation rules set out in § 5 or rights arising from non-performance or improper performance of the contract by the Service Provider.

§ 7. Arrival, stay and departure

1. The stay begins at 3:00 p.m. on the arrival date and ends at 11:00 a.m. on the departure date, unless the parties agree otherwise on a durable medium.

2. Standard key handover is available until 9:00 p.m. Arrival after 9:00 p.m. requires prior notice and purchase of the late check-in service. The fee for this service is PLN 150 and is added only after the Guest has been informed of the amount and has accepted the service before arrival.

3. The Guest should notify the Service Provider of an expected delay. Failure to arrive or make contact by 10:00 a.m. on the day following the planned arrival, despite an attempted contact by the Service Provider, is treated as a no-show. The Service Provider may release the Property for resale, and payments are settled in accordance with the selected rate.

4. When handing over the Property, the Service Provider may verify the identity of the Lead Guest by inspecting an identity document. No copy is made without a separate legal basis. Check-in may be completed online to the extent described in the Privacy Policy.

5. The Guest reports any defects, missing items or concerns about cleanliness promptly after discovering them, preferably on the arrival date. Failure to report them immediately does not automatically make the Guest liable for every damage discovered later.

6. With the Service Provider's consent and subject to availability, the Guest may extend the stay on the departure date until 1:00 p.m. for a fee of PLN 150. The service must be agreed in advance. Remaining at the Property after 11:00 a.m. without consent or after the agreed departure time constitutes a breach of contract. The Guest covers the resulting reasonable and evidenced costs, in particular additional assistance, delayed cleaning or claims by subsequent guests. The total amount due may not exceed the actual loss and reasonable costs incurred.

§ 8. Persons present at the Property

1. Only persons included in the booking may stay overnight at the Property. Any change in the group requires the Service Provider's prior consent and may result in a change to the Price, which will be presented before acceptance.

2. The Guest may not sublet the Property, transfer the booking to a third party without the Service Provider's consent or use the Property for activities contrary to the contract or the law.

3. Visitors may be present on the premises between 6:00 a.m. and 10:00 p.m. after the Service Provider has been informed, without any right to stay overnight. The total number of Guests and visitors present at the Property and on the premises at the same time may not exceed 10.

4. The Lead Guest undertakes to familiarise all persons included in the booking and all visitors with the stay rules. The Lead Guest is liable for their culpable acts in accordance with the law.

§ 9. Rules for using the Property

1. Guests must comply with the law, safety and fire protection rules, equipment instructions, good-neighbour principles and quiet hours from 10:00 p.m. to 7:00 a.m.

2. Smoking tobacco or electronic cigarettes and using open flames are prohibited inside the Property, except in designated places. Smoking is permitted only outdoors in the designated area.

3. Without separate written consent, parties, stag and hen parties, corporate events, eighteenth birthday parties, commercial activities, shoots involving a crew and events exceeding the declared number of persons are prohibited.

4. The barbecue may be operated only by an adult, in the place indicated by the Service Provider, using charcoal or briquettes. Fire must not be left unattended.

5. The playground and trampoline may be used only in accordance with their instructions, and children only under the direct supervision of an adult. The supervision requirement does not exclude the Service Provider's liability for the technical condition of the equipment under applicable law.

6. Bringing explosive or flammable materials onto the Property and using portable gas appliances, heaters or high-power electrical appliances that create a hazard is prohibited. This prohibition does not apply to ordinary personal electronics or necessary medical equipment used in accordance with the instructions.

7. Charging an electric vehicle is permitted only after notifying the Service Provider no later than at check-in and receiving confirmation that the service is available. A vehicle may be charged only at the point indicated by the Service Provider and in accordance with the instructions provided. The flat fee is PLN 100 for each day of the stay, regardless of the actual charging time or amount of energy consumed. The fee is not included in the basic Price and is added only after the Guest orders the service. Charging from any other socket or installation at the Property without the Service Provider's consent is prohibited.

8. The Guest may not carry out repairs or alterations at the Property without the Service Provider's consent unless immediate action is necessary to limit damage. The Guest must promptly report the need for repair.

9. When leaving the Property, windows and doors must be closed and appliances that should not remain switched on under their instructions must be turned off.

§ 10. Order, keys and parking

1. The Guest maintains ordinary cleanliness. Before departure, the Guest leaves dishes and kitchen equipment clean, places waste in the designated containers and removes personal belongings from the terrace. The Guest is not liable for normal wear and tear resulting from proper use.

2. In the event of soiling beyond ordinary post-stay cleaning, in particular requiring specialist laundry, ozone treatment, smoke removal, removal of excessive pet hair or unusual waste, the Guest covers the reasonable and evidenced cost of additional cleaning. The indicative cost of such a service starts at PLN 350, depending on the scope of work. If the actual cost is lower, the Guest pays the lower amount; if it is higher, the Service Provider provides a settlement or documents justifying the higher amount. If the smoking prohibition is breached, the indicative cost of odour removal, ozone treatment and laundry is PLN 500, while the final amount due corresponds to the actual reasonable and evidenced costs.

3. If a key or remote control is lost, the Guest covers the reasonable cost of replacement, reprogramming or, if reasonably necessary for security, replacement of the locking system. The amount of PLN 150 is indicative and does not replace determination of the actual cost.

4. Free, unguarded parking is available on the premises for up to 3 cars. A fourth and each additional car requires consent and a fee of PLN 40 per vehicle per day, disclosed before the service is ordered. Parking does not constitute a vehicle safekeeping service.

5. Vehicles may be parked only in the designated spaces. The Service Provider is liable for damage concerning a vehicle under the general rules of law and is not liable for events for which it bears no legal responsibility.

§ 11. Animals

1. A stay with an animal is permitted only after prior notification and confirmation of the terms by the Service Provider. Dogs and cats are accepted, with a combined maximum of 4 animals per stay. The Service Provider may refuse an animal for safety reasons, due to the characteristics of the Property or because no prior notice was given, subject to mandatory provisions concerning assistance dogs.

2. The fee for a dog weighing up to and including 12 kg is PLN 45 per day or EUR 10 per day for a booking settled in euros. The fee for a dog weighing more than 12 kg is PLN 65 per day or EUR 15 per day for a booking settled in euros. The fee for a cat is PLN 65 per day. A stay with a cat also requires the security deposit specified in § 12. The currency and fee amounts are stated and confirmed before the contract is concluded. Animal fees are itemised separately and added only after the Guest declares the animal.

3. A dog must remain under its handler's control, may not be left unattended, disturb the peace or stay on beds, mattresses or bedding. The Guest removes animal waste and complies with current vaccination requirements.

4. The Guest is liable for culpable damage caused by an animal. Cleaning or repair costs are determined in accordance with § 12.

§ 12. Security deposit and Guest's liability for damage

1. As a standard rule, the Service Provider does not collect a security deposit. A security deposit of PLN 1,000 is mandatory for a stay with a cat or with three or more dogs. The requirement and amount of the security deposit are disclosed to the Guest before the contract is concluded. The security deposit does not limit the Guest's liability.

2. The security deposit is payable when the booking is made or, if agreed, in cash no later than on the arrival date. A cash security deposit is returned on the departure date after the Property has been inspected, unless grounds for deduction are identified. If an immediate inspection is not possible or the security deposit was paid by non-cash means, it is refunded by bank transfer no later than 7 days after the end of the stay. In the event of a deduction, the Service Provider provides a description, documentation and settlement, and refunds the undisputed part within the above deadline.

3. Under applicable law, the Guest is liable for culpable damage to or loss of the Property's assets caused by the Guest, persons included in the booking, visitors or animals.

4. The amount of damage corresponds to the reasonable cost of repair, cleaning or restoration or, if repair is impossible or economically unjustified, the value of the item taking into account its age, condition and normal wear and tear. The attached list of equipment and prices is indicative.

5. The Service Provider may deduct from the security deposit a due and legally enforceable claim after providing the Guest with a settlement. If the damage exceeds the security deposit, the Service Provider may pursue the difference.

§ 13. Failures, access to the Property and Service Provider's liability

1. The Guest promptly reports a failure or event that may increase the damage and, where possible, takes reasonable action to mitigate its effects.

2. The Service Provider may enter the Property without the Guest's consent in the event of an imminent threat to life, health or property or when necessary to remedy a failure. In other cases, entry requires prior agreement of a reasonable time.

3. The Service Provider is liable for non-performance or improper performance of the contract in accordance with applicable law. These Regulations do not exclude liability that cannot lawfully be excluded or limited.

4. The Service Provider is not liable for temporary interruptions in utilities or external services if they result solely from circumstances beyond its control and could not have been prevented despite due care. If an interruption prevents a material part of the service from being provided, the Guest has the rights provided by law, including an appropriate settlement for the unperformed part.

5. Guests directly supervise children. This does not exclude the Service Provider's liability for damage resulting from its culpable act or omission or from the unsafe condition of equipment.

6. The Guest takes care of personal belongings and locks the Property. Liability for items brought onto the premises is governed by law, including Articles 846-849 of the Polish Civil Code where applicable. No notice or provision of these Regulations excludes liability that the law does not permit to be excluded.

§ 14. Material breach of rules and termination of stay

1. If the Guest materially breaches these Regulations, the Service Provider requests that the breach cease and sets an appropriate deadline, unless the breach creates an immediate danger or cannot be remedied due to its nature.

2. Material breaches include in particular: violence or threats; commission of a criminal offence; creating a fire hazard; serious or repeated disturbance of quiet hours; an undeclared party; exceeding the occupancy limit despite a warning; intentional damage to property; subletting; refusal to leave the Property after the booking has ended.

3. After an unsuccessful request, or immediately in the event of a serious danger, the Service Provider may terminate the contract and require the Guest to leave the Property. The settlement includes the due Price, amounts due for services already provided and documented damage, subject to consumer protection law. Payments are not automatically forfeited in full solely because of a minor breach.

§ 15. Additional services

1. A children's set comprising a high chair, baby bath and travel cot with mattress and bedding is available upon advance order for PLN 25 per day.

2. Other additional services and their prices are stated before selection. No paid option is selected by default.

§ 16. Complaints

1. A complaint concerning a booking or stay may be submitted to rezerwacje@orlidomek.pl or in writing to the Service Provider's address.

2. Where possible, a complaint should include the booking number, a description of the issue, the date on which it occurred, the Guest's request and contact details. The absence of any of these items does not deprive a consumer of rights if the complaint can still be considered.

3. Defects that can be remedied during the stay should be reported promptly so that the Service Provider can investigate and remedy them. This does not exclude the right to submit a complaint later.

4. The Service Provider responds to a consumer's complaint within 14 days of receipt, on paper or another durable medium, unless a specific provision sets a different deadline.

5. If the dispute is not resolved, the Service Provider provides the consumer on a durable medium with the information required by the Polish Act on Out-of-Court Resolution of Consumer Disputes, including whether it intends to participate in proceedings before the competent entity.

§ 17. Personal data and video surveillance

1. The controller of personal data is FHU Kamil Orlicki. The rules for processing personal data, including data processed by Smoobu and payment operators, legal bases, retention periods, recipients and data subjects' rights are set out in the Privacy Policy available at www.orlidomek.pl and provided before booking.

2. Data necessary to conclude and perform the contract are processed primarily to administer the booking and payments, comply with legal obligations and establish, pursue or defend claims. Consent is used only where it is the appropriate and voluntary legal basis, for example for optional marketing.

3. The external area of the Property is covered by video surveillance, including the gate, parking area, entrance and part of the yard. Surveillance does not cover the interior of the Property or places where Guests may reasonably expect privacy, and it does not record sound. Its purposes are to protect persons and property, ensure safety and establish, pursue or defend claims. Recordings are normally retained for 60 days and then automatically deleted, unless a particular recording is evidence of an incident or is required to establish, pursue or defend claims, in which case it may be retained until the relevant proceedings end or the applicable limitation period expires. Access is restricted to the Service Provider and individually authorised persons. The monitored area is marked, and full information about surveillance is provided in the Privacy Policy and at the entrance to the Property.

§ 18. Final provisions

1. Matters not regulated herein are governed by Polish law, in particular the Polish Civil Code, the Consumer Rights Act, the Act on Providing Services by Electronic Means and the applicable provisions on hotel services. The choice of Polish law does not deprive a consumer of the protection granted by mandatory provisions of the law of the country of the consumer's habitual residence, where applicable.

2. Disputes are resolved by courts having jurisdiction under generally applicable law. A consumer may use statutory assistance and out-of-court dispute resolution mechanisms.

3. These Regulations may be amended for valid reasons, in particular changes in law, the Service Provider's details, booking functionality or the scope of services. Amendments do not affect contracts concluded before the new version takes effect unless an amendment is required by mandatory law or has been individually agreed with the Guest.

4. Each booking is governed by the version of the Regulations provided to the Guest on a durable medium when the contract is concluded.

5. If any provision proves invalid or ineffective, the remaining provisions remain in force and the applicable provisions of law apply in place of the defective provision.

6. These Regulations apply from 1 June 2025. Each booking is governed by the version made available to the Guest before the contract is concluded and provided on a durable medium in accordance with paragraph 4.

Appendix 1 – Indicative equipment list

This list is intended to identify the equipment and provide an indication of costs. It is not an automatic schedule of compensation. Liability is determined in accordance with § 12 of these Regulations, based on the actual loss, repair options, age and wear of the item.

The list covers the main items of equipment. Other items are settled in accordance with § 12, taking into account normal wear and tear and the actual cost of repair or replacement.
